Terms of Service

These Terms of Service ("Terms") govern your use of QuickMapTools ("the Service"), operated by Daniel O'Donohue / MapScaping ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

QuickMapTools provides browser-based geospatial tools. All file processing runs locally in your browser via WebAssembly — your geospatial files are not uploaded to our servers. Paid "Pro" features include cloud-saved workflows and batch processing capabilities.

2. Accounts

You may use most of the Service without an account. An account is only required for Pro features. You are responsible for keeping your account credentials secure and for activity that occurs under your account. You must provide a valid email address.

3. Subscriptions and Billing

• Pro subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment processor.
• Subscriptions automatically renew at the end of each billing period unless you cancel before renewal. You can cancel at any time from the billing portal on your account page.
• Cancellation takes effect at the end of the current billing period. You retain Pro access until then.
• Prices are shown in US dollars and may change. We will give at least 30 days' notice of any price change affecting your renewal.

4. Refunds

All payments are non-refundable except where required by law or at our sole discretion. If you believe you have been charged in error, please contact us at sales@mapscaping.com.

5. Acceptable Use

You agree not to:

• Attempt to circumvent billing or access Pro features without a subscription;
• Use the Service to process unlawful content or infringe others' rights;
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
• Resell or repackage the Service without our written permission.

6. Intellectual Property

The Service, including its interface, branding, and original code, is owned by us and protected by copyright. QuickMapTools uses open-source libraries listed on our licenses page. You retain all rights to data and files you process through the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that output data is suitable for any specific decision, navigation, surveying, or regulatory purpose. Always verify outputs against authoritative sources.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of your use of the Service. Our total aggregate liability to you for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for breach of these Terms. You may stop using the Service at any time and cancel your subscription from the billing portal.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email or through the Service. Continued use after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of New Zealand. Disputes will be resolved in the courts of New Zealand, except where mandatory consumer-protection law provides otherwise in your jurisdiction.
